Terms & Conditions of Sale

1. Subject
These “Terms & Conditions of Sale” apply to the purchase of products via the www.sergiopesca.com site, which is owned by Sergio Pesca S.r.l., Via Degli Orti 93, 07041 Alghero (Sassari), Italy.
Every purchasing operation will be governed by the provisions set out in Italian Legislative Decree no. 185/99 and, in relation to the protection of privacy, will be subject to the regulations set out in Italian Law no. 675/96 as amended.

Please read these “Terms & Conditions of Sale” carefully before making any purchase.
We reserve the right to change these “Terms & Conditions of Sale” at any time.


2. Acceptance of the Terms & Conditions of Sale
Every order placed on www.sergiopesca.com implies the concluding of a contract of sale. By clicking on the “Confirm purchase” button, you are entering into a binding contract in relation to the items in the online shopping cart.

Once the purchase has been confirmed and the transaction completed, you will receive an e-mail (entitled “Confirmation of order on SergioPesca.com”) containing a summary of the order placed. On receipt of the “Confirmation of order”, the contract is deemed to be in force – should you not receive this e-mail, please get in touch with our Customer Service team.

3. Prices
All of the prices shown are in Euros and are inclusive of Italian VAT at the current rate. The transport and (if applicable) payment charges are shown prior to confirmation of the order. The products are charged at the prices shown on the site at the time of placing the order, taking no account of any changes in price that may be made subsequently or of any different prices that were offered previously.

4. Order
To place an order on the site, you must follow the procedure set out in the “How to order” guide. Upon “Confirmation of order”, you will receive an order confirmation e-mail sent to the e-mail address you have supplied. This confirmation summarises the chosen products, the relevant prices (including the shipping charges and any payment charges, if applicable), the shipping address and all of the specifications. You must verify the accuracy of the details and to inform us immediately of any corrections to be made. You will be liable for any increases in the shipping charges due to errors in the details you have provided but have then failed to highlight immediately so as to allow them to be corrected in time. The minimum order amount is €39.00, excluding the shipment charges.

On receiving the package, you must check carefully that there are no anomalies (strange bends, bumps, unusual adhesive tapes applied, etc.). In the event that the package displays any of these anomalies, you must sign that the goods are “RECEIVED BUT UNCHECKED”, in order to retain the possibility for reimbursement in the event of a complaint being submitted (if you sign for the package but do not include any statement of reservation, no reimbursement may be issued).

5. Product availability
The product stock information is updated automatically by the IT system. However, it may occur on occasion that certain products on sale are not currently in stock. In such cases, we will contact you immediately and offer a replacement product of comparable value or the partial reimbursement of that product – the choice of which option to accept is at your discretion.

6. “Sergio Pesca Rewards You”
The “Sergio Pesca Rewards You!” campaign enables you to accumulate points on your purchases. These points will be calculated based on the amount of the orders and then added to your account. During the order confirmation process, you may choose use one or more of the points previously earned. The points will be assigned as follows:

- 5 points are awarded for every €10.00 spent.
- To use them, you must have accumulated at least 100 points.
The points expire on an annual basis; they may be combined and used all together in a single order. The points cannot be exchanged for cash and do not attract interest. The points may be reduced should the customer decide to return the products ordered wholly or in part. The points may not be transferred to third parties.


7. Right to cancel
You have the right to cancel this contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day on which you acquire,or a third party other than the carrier and indicated by you acquires, physical possession of the last good. To exercise the right to cancel, you must inform us

of your decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model cancellation form, but it is not obligatory. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancel before the cancellation period has expired. Effects of cancellation If you cancel this contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.


8. Warranties
All products that contain the word “warranty” on their product page are covered by the official Italian warranty. Should you have a problem with one or more of these products, please write to us at assistenza@sergiopesca.com. In the e-mail, you should explain the problem, stating how it manifested itself and enclosing photographs of the product, the payment receipt and any warranty coupons. These photographs must show, as far as possible, the issues with the product in question, in order to facilitate and speed up the warranty turnaround process. We may not be able to provide immediate information on the turnaround times, which will depend on the decisions taken by the respective distributors. In any case, to move ahead with the warranty claim, you need to send back the product at your own expense, with all of its component parts as well as a copy of the payment receipt (and, if applicable, the warranty coupon). In the event that the guarantee is not granted, the shipping costs for returning the product to the customer are borne by the latter. We will do our best to ensure that the whole process is turned around rapidly and in a hassle-free way.

The warranty exclusions are set out below:
- Defects or damage caused by improper use, or having been dropped or subject to impact
- Defects or damage due to improper maintenance or repair
- Defects or damage caused by activities not associated with fishing, such as wilful destruction
- Defects or damage caused to the tip of the rod
- Defects or damage caused to the guides and the ring guides
- Changes or deterioration of the artificial parts of the product due to ageing
- In the event that the payment receipt is not available (and, in certain cases, accompanied by the warranty coupon).

10. Applicable law
These Terms & Conditions of Sale that support the contracts of sale are governed by Italian law (and specifically by the Consumer Code – Articles 46 and 47 of which cover distance selling – and by Legislative Decree No. 70 of 09/04/2003 on e-commerce) and must be interpreted in light of this legislation.

The European Commission provides a platform for online dispute resolutions (ODR) which can be accessed at http://ec.europa.eu/consumers/odr/
